German tourist wins lawsuit over 'towel laying' on Kos

A German tourist has successfully filed a lawsuit against his tour operator after a frustrating vacation on the Greek island of Kos. The court awarded him damages of 1,000 euros, German media reported.

The man had booked a package holiday for 7,186 euros to the Greek island of Kos in August 2024. Every day, he was confronted with the phenomenon all too familiar to tourists: reserving a deck chair by the pool with a towel early in the morning. Even if the man got up at the crack of dawn, there was hardly a spot to be found for him and his family.

The man made several complaints to the hotel staff and the tour operator, but no action was taken. The Hanover court now ruled that the tour operator should have acted on the structural problem. Because the pool was an essential part of the vacation and hotel rules were violated without consequences, the trip was deemed defective.

For ten vacation days, the trip price was allowed to be reduced by 15 percent per day. The tourist had already received 350 euros in compensation, but the judge deemed that insufficient. In the end, the district judge ruled that he was entitled to a total of 986.70 euros. The tour operator must therefore pay him an additional 636.70 euros.
