First U.S. state in the world to ban sale of farmed octopus

In 2024, with the signature of Governor Gavin Newsom, California brough the tlaw AB-3162 into force, which bans not only octopus farming in the State, but also the sale of derived products.

The vote in the California Senate was unanimous, a sign of cross-party support on an issue that combines ethics, science and the environment. After Washington State, California becomes the second U.S. state to ban the practice, but it's the first jurisdiction to extend the ban to commercialization, preventing production from being moved elsewhere.

Extraordinarily intelligent creatures

At the heart of the debate is the very nature of the octopus. Scientists describe it as one of the most intelligent creatures in the oceans: capable of complex problem-solving, curiosity, rapid adaptation and even individual behavioral traits. Their recognized sentience has fueled the concerns of researchers and organizations, who argue that intensive farming would be incompatible with their biological and cognitive needs.

In 2021, a report entitled 'Industrial octopus farming: a recipe for disaster' gathered scientific evidence on the risks of this emerging industry, highlighting the potential cruelty and environmental problems associated with an intensive production system. Subsequently, other analyses have turned the spotlight on some of the plans of companies wishing to start up large-scale breeding operations, such as the project to produce a million individuals a year on the Canary Islands.

A precedent that could make history

This two-pronged measure also responds to a specific request made by organizations such as the Aquatic Animal Alliance and numerous researchers: a simple production ban, without blocking sales, would run the risk of shifting the problem to other countries. On the contrary, the decision to ban the import and sale of farmed octopus closes the loop.

Meanwhile, the issue is also moving forward at federal level. California's decision could act as a pioneer, fuelling an international debate on how to reconcile food innovation, sustainability and respect for marine animals. For now, the message is clear: in California, the idea of turning octopus into a factory-farmed product has no place.
